The United States Supreme Court has indicated it will decide the issue of whether aliens can plead the Fifth Amendment right against self-incrimination if they fear being persecuted in their home countries. 

The Clinton Administration is against extending such rights because of a fear of the impact on international crime. The Clinton Administration is pushing for an interpretation that would only allow reliance on the Fifth Amendment only as a matter of last resort.

The Second Circuit US Court of Appeals has ruled that immigrants can invoke the Fifth Amendment. The Supreme Court should issue a decision on the case by the summer.
