Despite regular announcements by pundits that immigration reform is dead for this Congress, there are still serious efforts to move legislation. Numerous House Republicans have said they would not conference with the Senate on S.744, the immigration bill passed by the upper chamber last summer. The demands of House members to pursue piecemeal lawmaking on immigration appears to be gaining momentum as President Obama and Senator Dick Durbin (D-IL) both have noted in the last week that piecemeal lawmaking is possible.

You all no doubt were frustrated at the federal government shutdown that occurred earlier this month. Many aspects of the shutdown got a lot of publicity. But the impact on the immigration system was not as well understood. USCIS was able to stay open because it operates using fee receipts. However, many applications could not be filed because they must be accompanied by Department of Labor certifications which were not processed in the shutdown. Since the government reopened, the Department of Labor’s online filing system has been plagued with problems and applicants have had a great deal of difficulty filing cases. Even today, weeks after the shutdown ended, the iCert program was still being taken down to fix the ongoing problems.
